1. Agreement to Terms

MenuPhotoAI is an AI-powered image enhancement service specifically designed for food photography. Our Service allows users to upload food images and receive professionally enhanced versions using artificial intelligence technology.

2.1 Service Features

The Service includes AI-powered food photo enhancement, cloud-based image processing, multiple output formats and resolutions, user account management, and subscription and credit-based billing systems.

2.2 Service Availability

While we strive to maintain 99% uptime, we do not guarantee uninterrupted availability of the Service. We may perform maintenance, updates, or modifications that temporarily affect service availability. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

3. User Accounts and Registration

3.1 Account Creation

To create an account, you must provide accurate and complete information during registration and maintain the security of your account credentials. You must be at least 16 years old to create an account. Each user is permitted only one account; multiple accounts are prohibited.

3.2 Account Security

You are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breaches. We are not liable for any losses resulting from unauthorized account access due to your failure to maintain account security.

3.3 Account Termination

We reserve the right to suspend or terminate your account immediately, without notice, for violation of these Terms, fraudulent or illegal activity, abuse of the Service or other users, non-payment of fees, or any other reason at our sole discretion.

4. Image Upload and Processing

4.1 Acceptable Content

You may only upload images that contain food, beverages, or culinary subjects; are owned by you or for which you have proper rights; do not violate any laws or third-party rights; and are in supported formats (JPEG, PNG, WebP).

4.2 Prohibited Content

You may not upload images containing illegal, harmful, or offensive content; copyrighted material without permission; personal information of third parties; malicious code or viruses; or non-food subjects (unless incidental to food photography).

4.3 Processing Results

AI enhancement results may vary based on image quality and content. We do not guarantee specific enhancement outcomes, and processing times may vary based on system load and image complexity. Failed processing attempts will result in automatic credit refunds.

5. Intellectual Property Rights

5.1 Your Rights to Enhanced Images

You retain the right to use enhanced images for any commercial or personal purpose. You may distribute, modify, and monetize enhanced images without restriction, and no attribution to TastingTones Technologies Ltd is required for your use of enhanced images.

5.2 Our Rights to Your Uploaded Images

CRITICAL TERMS - READ CAREFULLY:

By uploading any image to our Service, you hereby grant us perpetual, irrevocable, worldwide, royalty-free license to use your uploaded images and transfer full ownership rights of uploaded images to TastingTones Technologies Ltd. You waive any moral rights or attribution requirements and consent to our unlimited use of your images for any purpose, including training and improving AI models, marketing and promotional materials, research and development, creating derivative works, commercial exploitation in any form, and sublicensing to third parties.

5.3 Our Intellectual Property

The Service, including all software, algorithms, and AI models, is our proprietary technology. All Service branding, trademarks, and copyrights belong to us. You may not reverse engineer, copy, or create derivative works of our Service.

6. Payment Terms and Billing

6.1 Subscription Plans

We offer various subscription tiers with different feature sets and credit allocations. Subscriptions automatically renew unless cancelled. Subscription fees are non-refundable except as required by applicable law.

6.2 Credit System

Credits are consumed for each image processing request and expire according to your subscription terms. Unused credits do not roll over between billing periods. Failed processing attempts receive automatic credit refunds.

6.3 Payment Processing

All payments are processed securely through Stripe. You authorize us to charge your payment method for applicable fees and are responsible for maintaining valid payment information. Disputed charges must be reported within 30 days.

6.4 Price Changes

We may modify pricing with 30 days' notice to existing subscribers. Price changes apply to subsequent billing cycles. You may cancel your subscription to avoid price increases.

6.5 Refund Policy

No refunds are provided for subscription fees or credit purchases, with exceptions for automatic credit refunds for failed processing attempts and refunds required by applicable consumer protection laws.

7. Data Storage and Retention

7.1 Image Storage Periods

Original images are automatically deleted after 20 days. Enhanced images for paid subscribers are stored indefinitely during active subscription, while enhanced images for free or expired users are deleted after 90 days.

7.2 Account Data

Account information is retained while your account is active. Data may be retained for legal or business purposes after account closure, and backup copies may persist in our systems for technical reasons.

8. Prohibited Uses and Conduct

8.1 Prohibited Activities

You may not use the Service for illegal purposes or in violation of any laws; upload malicious content, viruses, or harmful code; attempt to gain unauthorized access to our systems; reverse engineer or attempt to extract our proprietary technology; use automated tools to access the Service such as bots or scrapers; resell or redistribute access to the Service; share account credentials with others; or create multiple accounts to circumvent limitations.

8.2 Consequences of Violation

Violations of these Terms may result in immediate account termination without refund, legal action for damages or injunctive relief, and reporting to relevant authorities if criminal activity is suspected.

9. Service Limitations and Disclaimers

9.1 Service Limitations

Processing capacity may be limited during peak usage. AI enhancement quality depends on input image characteristics, and some image types may not be suitable for our enhancement algorithms. We do not guarantee specific processing times or results.

9.2 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT the Service will be uninterrupted or error-free, that defects will be corrected, that the Service is free of viruses or harmful components, or that results will meet your specific requirements.

10. Limitation of Liability

10.1 Damages Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10.2 Excluded Damages

WE SHALL NOT BE LIABLE FOR indirect, incidental, or consequential damages; loss of profits, data, or business opportunities; service interruptions or data loss; third-party actions or content; or acts of God, natural disasters, or force majeure events.

11. Termination

11.1 Termination by You

You may terminate your account at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds will be provided for unused portions of prepaid subscriptions.

11.2 Termination by Us

We may terminate your account immediately, with or without notice, for breach of these Terms, illegal or harmful activity, extended periods of inactivity, or business reasons at our sole discretion.

11.3 Effects of Termination

Upon termination, your access to the Service will be immediately revoked, your data will be deleted according to our retention policies, our rights to your uploaded images remain in effect, and you remain liable for any unpaid fees.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

You agree that any disputes will be resolved individually and not as part of a class action or collective proceeding.
